Misconduct occurring while a government agent is investigating, inspecting, regulating, enforcing, administering a program, making an official decision, supervising personnel, or otherwise exercising public authority.
Misconduct connected to government employment, official status, public resources, security access, or continuing professional obligations but occurring outside an active assignment or regular duty function.
Misconduct occurring in a private capacity without an immediate official function, while remaining relevant to integrity, credibility, security, professional fitness, or public confidence in government administration.
Improperly restricting access to counsel, intruding on privilege, obstructing representation, denying notice or reasons, impairing participation, or disregarding required procedural protections.
